In compliance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties and other applicable provisions, Schulder, S.A. de C.V., taxpayer registry number (RFC) SCH120116D7A, with address at Zapopan, Jalisco, México (the “Controller”), makes this Privacy Notice available to users.

1. Personal data we collect

To use certain features of this site, including discovery, diagnostic, assessment and profiling questionnaires, we may request:

  • Name.
  • Email address.
  • Company or organisation, where provided.
  • Role or function within an organisation, where provided.
  • Information included by the user in questionnaire answers.

The questionnaires are designed mainly to gather information about business processes, technology, operations, commercial needs, organisational structure, technology projects and/or processes relating to forming and operating companies in the United States.

In addition, the profiling questionnaire for forming companies in the United States expressly requests, for that specific purpose:

  • The user’s immigration status in the United States.
  • Whether or not the user, and where applicable their partners, hold United States tax identifiers (SSN or ITIN).
  • Whether or not the user holds a valid passport.

These questions are answered by choosing from general options. We never request the social security number, the ITIN number, the passport number, or a copy or image of any official document. That questionnaire is the mechanism specifically intended and protected for collecting this information.

Apart from the above, we do not intentionally request sensitive personal data, medical information, biometric data, passwords, credit card information, banking data, social security numbers, immigration information or official identity documentation through these questionnaires. Users should avoid providing such information unless it is expressly requested through a mechanism specifically intended and protected for that purpose.

2. Purposes of processing

The data collected may be used for the following primary purposes:

  • Identify the user completing a questionnaire.
  • Associate answers with a given person, company, project or request.
  • Analyse the user’s needs, objectives, processes and project characteristics.
  • Carry out discovery, diagnostic and technological or business profiling activities.
  • Prepare recommendations, proposals, assessments, project scopes or work plans.
  • Assess requirements relating to technology services, consulting, software development, business structuring or company formation in the United States.
  • Compile and deliver a profiling file to an external accounting and/or legal firm, so that the firm may analyse the user’s case.
  • Follow up on requests, conversations or projects initiated by the user.
  • Communicate with the user regarding their answers or requests.
  • Keep internal records relating to the provision and improvement of our services.
  • Protect the security, availability and integrity of our systems and services.
  • Comply with legal obligations or respond to validly issued requests from competent authorities.

The information provided will not be sold or commercialised as a database to third parties.

3. Information contained in the questionnaires

Answers provided by the user may contain business, technical, operational, strategic or commercial information. The Controller will process such information exclusively for purposes relating to the assessment, provision or potential provision of the requested services.

Without prejudice to confidentiality obligations that may later be established through contracts or non-disclosure agreements, the Controller will apply reasonable measures to prevent unauthorised access, use, disclosure, alteration or loss of the information provided.

4. Use of technology providers

To operate this site and provide our services we may use technology providers, including services for infrastructure and database hosting, cloud storage, sending and receiving email, information security, backups, communications, analytics and technical monitoring, and tools used to process or analyse information relating to our services.

Specifically, questionnaire answers are sent to an external artificial intelligence provider in order to produce an ordered summary of the case. Answers are not used to train models.

These providers may process information only to the extent necessary to deliver the services contracted by the Controller and are subject, where applicable, to contractual obligations of confidentiality, security and data protection. Some of these providers may operate infrastructure located outside Mexico, particularly in the United States or other countries.

5. Transfers of information

The Controller will not transfer personal data to independent third parties for commercial purposes outside those described in this Notice. Data may be disclosed or transferred where necessary:

  • to provide a service expressly requested by the user;
  • to the external accounting and/or legal firm that will analyse the user’s case, where the user completed the questionnaire for forming a company in the United States;
  • to providers or collaborators taking part in the provision of the relevant service;
  • to comply with obligations arising from a legal relationship;
  • where a legal obligation exists;
  • where required by a competent authority;
  • to protect the legal rights of the Controller or the user; or
  • in the other cases permitted by applicable law.

Where a transfer legally requires additional consent from the data subject, such consent will be requested beforehand.

6. Retention of information

Personal data will be kept only for as long as reasonably necessary to fulfil the purposes described in this Notice, maintain the relationship with the user, address potential legal liabilities and comply with applicable obligations. When data is no longer necessary it may be deleted, anonymised or blocked in accordance with our retention policies and applicable law.

7. Information security

The Controller adopts reasonable administrative, technical and organisational measures aimed at protecting information against loss, alteration, destruction, unauthorised access, misuse or unauthorised disclosure.

No system connected to the Internet can guarantee absolute security. We nonetheless seek to use controls and practices proportionate to the nature and sensitivity of the information processed.

8. ARCO rights

At any time the data subject may exercise their rights of Access (know what personal data we hold and how we use it), Rectification (request correction of incorrect or outdated information), Cancellation (request deletion where legally appropriate) and Objection (object to processing for certain purposes). They may also request limitation of the use or disclosure of their personal data and, where applicable, withdraw their consent.

To exercise any of these rights, send a request to: privacidad@schulder.mx

The request must contain enough information to identify the data subject and clearly specify the right being exercised or the information concerned. We may request additional information only where necessary to verify the requester’s identity or locate the relevant data.

9. Commercial communications

Sending information directly related to a request, questionnaire, diagnostic, project or service requested by the user is considered part of the communication necessary to address that request.

Where we use contact information for independent promotional or commercial communications, the user may at any time ask to stop receiving them through the mechanisms provided in those communications or by writing to privacidad@schulder.mx.

10. Cookies, technical logs and analytics

The site may use cookies and similar technologies necessary for its operation, security, session maintenance and improvement of the user experience.

Our servers and technology providers may also automatically generate technical logs such as IP address, browser type, device, date and time of access, pages visited and technical events.

Where non-essential analytics tools are used, the site may offer additional information, consent or configuration mechanisms where applicable law so requires.

11. Minors

The services and questionnaires on this site are aimed at adults and at representatives of companies or organisations. We do not intentionally collect personal information from minors.

12. Changes to this Privacy Notice

The Controller may update this Privacy Notice as a result of legal, regulatory, operational, technological or service-related changes. The current version will be permanently available at schulder.mx and on this page. The date of the last update appears at the top of this document.

13. Consent

By providing personal data through this site after having had access to this Privacy Notice, the user acknowledges having been informed about the characteristics and purposes of its processing. Where the law requires express consent for a specific processing activity, it will be requested through the corresponding mechanism.
